Before using services provided by Moon lit, you need to read the Terms of Service (hereinafter referred to as “the Terms”, “these Terms”) and comply with the Terms when you use the services. Please do read the Terms carefully, especially those relevant to indemnification or limit of liability. If you don’t agree to any of these Terms, you cannot use the services Moon lit offers. By accessing the services in Moon lit, you’ve read and agree to be governed by the Terms. If you are under 18 years of age or do not have full civil capacity, you should read the Terms together with your guardians and pay special attention to terms relevant to users under 18. Otherwise Moon lit will not be responsible for any adverse consequences that may occur to you as a result of such subsequent registration or use of our services. And Moon lit will reserve the right to terminate your use of our services.
Clause 1. Scope of the Terms
The Terms are an agreement between you and an operator of Moon lit (hereinafter might be referred to as “we”, “us”, “our”). Any use of the services or products under Moon lit by any user is governed by these Terms. The term “operator” of Moon lit is a legally recognized entity responsible for operating Moon lit. The term “user” is you or anyone who use the products or services offered by Moon lit.
Clause 2. Security of your account and password
2.1 You need to register for an account before you can access to our services.
2.2 Moon lit reminds you to keep your account and password to your own. You should log out whenever you want to have a break from our services. You are responsible for any theft of your account or password that may occur as a result of improper storage.
2.3 Moon lit recommends that you set up a password that include at least three of the following four elements: upper-case letters; lower-case letters, numbers, and special symbols. You are responsible for any theft of your account of password that may occur as a result of improper storage. Moon lit will not be held responsible for any account insecurity, unauthorised privacy disclosure that are not the fault of Moon lit, or any losses arising out of or in connection with such account insecurity or unauthorised privacy disclosure to any party.
Clause 3. How Moon lit is keeping your personal Information safe.
3.1 Moon lit takes it as a fundamental principle to securing Moon lit users’ personal information.
3.2 When registering for an account or using our services, you need to provide some information necessary for the register and use. When required by laws and regulations, you will need to provide authentic information about yourself. If the information you provide is incomplete, you will not be allowed to use any of our services or will be restricted to only some of them.
3.3 You may review and modify the information you provide at any time. For the sake of security and the need of identification (used when users want to reclaim their accounts, for example), however, you will not be allowed to modify the initial information you provided when you register for your account and other information relevant to identification.
3.4 Moon lit will use all possible security technologies and procedures, with which we will establish an integrated information management system as to secure your personal information from unauthorized access, use or disclosure.
3.5 Moon lit will not disclose your personal information to any company, organization or individual other than Moon lit without your consent, except as otherwise required by laws and regulations.
3.6 Moon lit is committed to securing the personal information of minors. If parents (guardians) think it’s necessary for their underaged children (especially those who are under 10) to use services offered by Moon lit, they may register an account for their children, but the account must be registered in the name of one of the parents (guardians), who will decide whether the services we provide are suitable for the minors. Moon lit warrants that we will not disclose to public or to any third-party users’ registration information or any non-public content, data, and information that are stored on Moon lit platform, server, or database when users use our online services unless:
(1) You give Moon lit prior permission to disclose your information;
(2) It is required by applicable laws and regulations;
(3) It is ordered by government sectors or judiciary authorities;
(4) It is necessary for the sake of public interests;
(5) It is necessary for securing Moon lit’s legitimate rights and interests.
Clause 4. Your commitments to Moon lit.
4.1 What you can do on Moon lit.
(1) Unless otherwise agreed between you and Moon lit, you agree to use our services only for your personal and non-commercial purposes.
(2) You must use our services in ways that are made available to you by Moon lit or approved by Moon lit. Your rights under these Terms are non-transferable.
(3) You may not use any plug-ins or third-party tools that are not authorised by Moon lit to interrupt, destroy, modify, or otherwise influence the services under these Terms.
4.2 Any violation of the above terms and conditions is regarded as your serious breach of the Terms. When such violation happens, Moon lit may suspend or terminate your use of our services, withhold the fees you paid as liquidated damage, and make legal claims against you if Moon lit’s losses exceed the amount withheld from you.
Clause 5. Our services are provided to you on an “as is” and “as available” basis.
You acknowledge and agree that our services are provided to you to the extent supported by existing technologies and other conditions. Moon lit will do its best to provide you with services to ensure the continuity and security of services; however, Moon lit cannot foresee and prevent legal, technical, and other risks at any time, including but not limited to force majeure, viruses, Trojan horses, hacker attacks, system instability, Service interruption, data loss and other losses and risks may be caused by third-party service defects, government actions, etc.
Clause 6. You need to have a device before accessing Moon lit.
6.1 You should understand that you need to prepare your own terminal equipment (such as computers, modems, and other devices) related to related services when you use Moon lit's services, and bear the required expenses (such as telephone charges, Internet access charges, etc.).
6.2 You understand and agree that your use of this service will consume resources such as your terminal equipment and bandwidth
Clause 7. Advertising.
7.1 You agree that Moon lit may, by itself or by authorising third-party advertisers to, send you advertisements (“ads”) or promotions (including commercial and non-commercial information) in the process of providing services to you. Moon lit may at its own discretion change the channels and scope of its ads and promotions without special notice to you.
7.2 Moon lit performs relevant obligations to advertisers in accordance with laws. You must at your own discretion judge the authenticity of information in any ads and be responsible for your own judgements. Unless otherwise stated by laws, Moon lit is not responsible for any loss or damage suffered as a result of the content of such ads or of your transactions in accordance with such ads.
7.3 You agree that you will carefully judge the authenticity and reliability of the ads shown to you by Moon lit. You will be responsible for your transactions in accordance with such ads, unless otherwise stated by laws.
7.4 You agree that you paying for any service or function provided by Moon lit will not relieve you from accepting ads provided by Moon lit. As this is a valid consideration for Moon lit to provide a comprehensive service to all users, your reading these Terms constitutes an acknowledgement and agreement to the rule.
Clause 8. Subscription to our products and services.
8.1 You acknowledge and agree that Moon lit has the right to provide its services for free or to require users to pay for their use of the services; the amount we charge is generic fee collected by Moon lit for the purpose of charging end users for the Internet Value Added Service. The amount you top up on Moon lit will only be used for the services under these Terms. Moon lit will not refund the consumed amount after the recharge is completed. If any user applies for a refund for the unconsumed recharge amount in the user's account and this application is approved by Moon lit, Moon lit will return the amount to the user in the legal currency. The refund will be returned to the user in the payment method with which it was paid to Moon lit, and 10% of the amount will be withheld by Moon lit as a refund fee. If any refund cannot be made in the payment method with which it was paid to Moon lit under special circumstances, you may Contact Us and ask for a refund by providing an account with which you collect your refund.
8.2 You acknowledge and agree that Moon lit has the right to modify its charging standards and rules at its own discretion. Such standards and rules will take effect once published and constitute a valid part of these Terms. Moon lit may, as required by situations, modify, and change its charging standards and methods of its fee-based services, and may start charging for services that used to be free. We will notify you or place a public notice on relevant pages before we make changes to our charging standards, rules, or methods. If you do not agree to our updated charging standards, rules, or methods, you may stop using our services. By continuing use our service, you agree to the updated charging standards, rules, or methods.
8.3 Some services of Moon lit are provided on a fee-based basis. If you use these services, you must comply with the relevant terms. Moon lit will remind you on relevant pages that if you refuse to pay such fees, you will not use those fee-based services.
8.4 Moon lit will have the right to decide the charging standards and methods for the services provided by Moon lit. The charging standards and methods may vary from different services and may vary from different stages of a service.
8.5 Moon lit may, as required by situations, modify, and change its charging standards and methods of its fee-based services, and may start charging for services that used to be free. We will notify you or place a public notice on relevant pages before we make changes to our charging standards, rules, or methods. If you do not agree to our updated charging standards, rules, or methods, you may stop using our services.
8.6 Moon lit provides a pay-to-read reading service with a term of one month from the date you pay to subscribe to pay-to-read chapters. Moon lit will only guarantee that you can read our pay-to-read stories within the above-mentioned period, and Moon lit will not be responsible for any failure that happens when you read our stories when the above-mentioned period is over.
8.7 Top-up
8.7.1 Our products will be purchased with virtual coins, and applicable virtual coins may vary from product to product. When purchasing any product of ours, you must use the right virtual coins that apply to that product.
8.7.2 You acknowledge and understand that you may not trade virtual coins with other users on Moon lit. Any trading of virtual coins between users constitutes a violation of these Terms, and Moon lit reserves the right to take appropriate measures, without notice, to ensure users cannot trade virtual coins on the platform.
8.7.3 You acknowledge and agree that once you top up, you may not request any refund, or demand any change or modification to that top-up. You may not request any refund even if there are still virtual coins left in your account after you purchase any product of ours.
8.7.4 When you top up on products provided by Moon lit, you must double-confirm the account and other necessary information. You may not place any compensations or claims against Moon lit whenever you top up to a wrong account or select a wrong charging plan due to your improper operation or insufficient understanding of our charging policies and suffer any loss or damage because of that.
8.7.5 If you use services provided by third-party payment companies when recharging, you will comply with all terms, rules, and policies of the third-party. You will try your best to secure your personal information, including but not limited to bank account number, password, verification code. You agree and confirm that Moon lit will not be held responsible for any dispute arising out of or in connection with payment services offered by third-parties.
8.7.6 If your account is frozen and/or terminated due to violation of the Terms, you may not place any compensations or claims against Moon lit.
8.7.7 It there is any mismatch between the amount you pay and the amount we receive due to the failure of our platform, we will make proper remedies to that mismatch provided that the relevant data is restored and you can provide legitimate and valid evidence for that mismatch.
8.7.8 If the amount we receive is less than the amount you pay due to the failure of our platform, we will make up the difference.
8.7.9 If the amount we receive is more than the amount you pay due to the failure of our platform, we will have the right to recover the difference.
8.7.10 You acknowledge and agree that once you subscribe to any story on Moon lit, you cannot apply for any change or modification to that subscription. Unless otherwise approved by Moon lit, you may not claim for any refund for the virtual coins you paid for any subscription. Even when there is suspension or suspension of the services provided by Moon lit, or when the story you paid for is removed from Moon lit, the virtual coins you paid when subscribing for a pay-to-read story will not be refunded.
Clause 9. How you claim your earnings.
If you create and publish works (including but not limited to: novels, poems, book reviews, etc.) on Moon lit, you are willing to accept gifts, update reminders, and/or other virtual products or services given to you by Moon lit as rewards. A fee (no more than 50%) will be deducted from the rewards users give to you by us before we distribute them to your account. If you refuse to accept such rewards or refuse to accept the deduction of the fees, it is deemed that you do not accept the Terms, then you cannot use services and functions on Moon lit such as publishing works on it. To ensure that others users can use our services or functions, we have the right not only to restrict your access to above functions and services, but also to suspend or terminate any service between you and Moon lit.
Clause 10. Products or services from third parties.
When you use products or services provided by third parties on Moon lit, you must comply with both the Terms and any term of service of the third parties. Moon lit and third parties are solely responsible for their own possible disputes within the scope of applicable laws and agreements.
Clause 11. Software.
11.1 You need to download software in the process of using our services, for which Moon lit grants you a personal, non-transferable, and non-exclusive license. You may use the software only for the purpose of accessing or using our services.
11.2 In order to improve user experience, ensure the security of our services and the functional consistency of our products, Moon lit may update its software. You should update the relevant software to the latest version, otherwise Moon lit does not guarantee that it will work properly.
Clause 12. Intellectual property.
12.1 The copyrights or trademark rights of the commercial logos used by Moon lit in its services are owned by Moon lit.
12.2 The copyrights, trademark rights, trade secrets, and other intellectual property rights, ownership rights or any other rights of all information, materials, texts, software, sounds, pictures, videos, graphics (including relevant software) in connection with services provided by Moon lit are owned by Moon lit or its right holders, and are protected by relevant laws of the People's Republic of China and international agreements and treaties that the People's Republic of China has joined. You may not modify, copy, distribute, transmit, display, perform, reproduce, license, transfer, sell or create derivative works for any such information, materials, texts, software, audio, pictures, videos, graphics, unless you have obtained prior legal authorization from Moon lit or its right holders. If you fail to comply with the above provisions in this Clause, Moon lit may immediately terminate the provision of services to you without prejudice to other rights, and you must destroy any of the above-mentioned information, materials, text, software, audio, pictures, videos, graphics that you have obtained. Any violation of the above terms and conditions is regarded as your serious breach of the Terms. When such violation happens, Moon lit may suspend or terminate your use of our services, withhold the fees you paid as liquidated damage, and make legal claims against you if Moon lit’s losses exceed the amount withheld from you.
Clause 13. Breach from users.
13.1 You must abide by laws and regulations when using our services, and may not use our services to engage in illegal or unlawful activities, including but not limited to:
(1) Publish, transmit, disseminate, and store content that endangers national security and unity, destroys social stability, violates public order and morals as well as any content that is abusive, libellous, pornographic, or sexually explicit, violent, and any other content that violates national laws and regulations;
(2) Publishing, transmitting, disseminating, and storing content that infringes upon the intellectual property rights, trade secrets and other legal rights of others;
(3) Maliciously fabricating facts, concealing the truth to mislead or deceive others;
(4) Publishing, transmitting, and disseminating advertising information and spam;
(5) Other acts prohibited by laws and regulations.
13.2 If you violate this clause, relevant state agencies or institutions may bring lawsuits, fines or other sanctions against you, and request Moon lit’s assistance. If any damage is caused, you shall compensate according to law, and Moon lit shall not be held liable.
13.3 If Moon lit finds that the information you publish violate this Clause or receives reports from others that the information you publish violates this Clause, Moon lit has the right at its own discretion to take technical measures to delete, block or disconnect the information. At the same time, Moon lit has the right to take measures including but not limited to suspending or terminating services, restricting, freezing, or terminating account usage, and pursuing legal responsibilities, depending on the nature of your behaviour.
13.4 You shall be solely responsible for any third-party damage caused by your violation of this Clause, and you shall also compensate Moon lit for any damage suffered as a result.
13.5 Any violation of this Clause is regarded as your serious breach of the Terms. When such violation happens, Moon lit may suspend or terminate your use of our services, withhold the fees you paid as liquidated damage, and make legal claims against you if Moon lit’s losses exceed the amount withheld from you.
Clause 14. Compliance with local laws and regulations.
14.1 You should abide by relevant local laws and regulations and respect local morals and customs in the process of using our services. If you act in breach of local laws, regulations, or morals, you should be solely responsible for your act.
14.2 You shall avoid involving Moon lit in political and public events by using its services, otherwise Moon lit reserves the right to suspend or terminate its services to you.
14.3 Any violation of this Clause is regarded as your serious breach of the Terms. When such violation happens, Moon lit may suspend or terminate your use of our services, withhold the fees you paid as liquidated damage, and make legal claims against you if Moon lit’s losses exceed the amount withheld from you.
Clause 15. Complaints from third parties
15.1 You are solely responsible for the content (including but not limited to web pages, text, pictures, audio, video, graphics, etc.) that you send or transmit via our services.
15.2 The content you send or disseminate should be of legal origin, and the content should be owned by you or you have obtained the authorisation of it from the right holder.
15.3 You agree that Moon lit may, for the purpose of performing these Terms or providing its services to you, use the content you send or transmit.
15.4 If Moon lit receives a notice from a right holder claiming that the content you send or disseminate infringes their relevant rights, you agree that Moon lit has the right to, at its own discretion, take measures such as deleting, blocking, or disconnecting the content.
Clause 16. Force majeure and other indemnification
16.1 You acknowledge and agree that in the process of using the service, risks such as force majeure may be encountered, which may cause disruptions to our services. Force majeure refers to objective events that cannot be foreseen, overcome, or avoided, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plague epidemics and storms, as well as social events such as wars, unrest, government actions, etc. In the event of the above, Moon lit will endeavour to cooperate with relevant entities in the first instance to make timely repairs, but Moon lit is exempted from liability for any damage caused to you as a result, to the extent permitted by law.
16.2 To the extent permitted by law, Moon lit shall not be liable for service interruptions or disruptions resulting from:
(1) Damage by computer viruses, Trojan horses or other malicious programs, hacker attacks;
(2) Failure of your or Moon lit’s computer software, systems, hardware and/or communication lines;
(3) Improper user operation;
(4) Unauthorised use of our services from you;
(5) Other circumstances beyond Moon lit’s control or reasonably foreseeable.
16.3 You acknowledge and agree that in the process of using this service, you may encounter risks brought by network information or other users’ actions. Moon lit is not responsible for the authenticity, applicability, and legality of any information, nor for damages caused to you by infringement. These risks include but are not limited to:
(1) Information containing threatening, defamatory, objectionable, or illegal content from others anonymously or under false pretences;
(2) Any psychological, physical harm and economic loss caused or likely to be caused by others' misleading, deceit or other causes or possible causes due to the use of our services under the Terms;
(3) Other risks arising from network information or user behaviour.
16.4 You acknowledge and agree that our services are not designed for certain specific purposes, including but not limited to nuclear facilities, military use, medical facilities, transportation and communication, and other critical areas. Moon lit shall not be liable for any injury or death to persons, property damage, environment damage, etc. if the above operations fail due to the failure of any system or service.
16.5 Moon lit obtains the right to deal with illegal content in accordance with these Terms. This right does not constitute obligation or commitment on the part of Moon lit, and Moon lit cannot guarantee that any violation of the Terms will be detected or dealt with accordingly in a timely manner.
16.6 Under no circumstances should you rely on loans, requests for passwords or other online messages concerning assets or properties. When assets or properties are involved, please always verify the identity of the other party first and keep in mind Moon lit’s tips on fighting fraudulence.
Clause 17. Effectiveness and modification of the Terms
17.1 By accessing the services in Moon lit, you’ve read and agree to be governed by the Terms.
17.2 Moon lit reserves the right to amend these Terms when necessary. You can review the latest version of the Terms on relevant service pages.
17.3 If you continue to use the software or services provided by Moon lit when the Terms are updated, you are deemed to have accepted the updated Terms. If you do not accept the updated Terms, you should stop using the software or services provided by Moon lit.
Clause 18. Change, Interruption and Termination of Services
18.1 Moon lit may make changes to its services, and may also interrupt, suspend, or terminate its services.
18.2 Moon lit reserves the right to interrupt or terminate its services provided to you without notice in the event of the any of the following:
(1) You are required by law to submit authentic information about you but you provide information that is untrue or inconsistent with the information you provide when registering for your account and you cannot provide any reasonable explanation for that.
(2) You violate relevant laws and regulations or the clauses under the Terms;
(3) It is ordered by government sectors or judiciary authorities;
(4) For security reasons or other necessary circumstances.
Clause 19. Choice of law and jurisdiction.
19.1 These Terms takes effect and are entered into, performed, and interpreted in accordance with applicable laws (Excluding Conflict of Laws) in the mainland of the People’s Republic of China. All disputes arising out of or in connection with these Terms will be resolved in accordance with applicable laws (Excluding Conflict of Laws) in the mainland of the People’s Republic of China.
19.2 Should any conflicts or disputes arise between you and Moon lit, you agree to negotiate in good faith with Moon lit. Where such a negotiation fails, you agree to submit the conflicts or disputes to the China International Economic and Trade Arbitration Commission for arbitration.
19.3 Headings are used in these Terms for reference only and will not be considered when interpreting these Terms.
19.4 If any term, condition, or provision in these Terms is found to be invalid or unenforceable to any extent for any reason, the remaining terms, conditions, and provisions will continue to be valid and binding to both parties.
Clause 20. For users under 18.
20.1 If you are under the age of 18, you are deemed as a minor and should read these Terms and use our services under the supervision and guidance of a guardian.
20.2. Minor users are not yet familiar with the world and are easily misled by contents on the Internet. In addition, they are curious about their surroundings but are not able to protect themselves when dangers arise, and therefore are easily endangered. Given this fact, minor users should pay attention to the following matters when using our services so that they will be better secured from potential dangers.
(1) Have a clear understanding of the difference between the online world and the real world, and avoid becoming addicted to the Internet and have their daily lives impacted as a result.
(2) Try their best to protect their personal information;
(3) Use the internet properly and under the guidance of a guardian;
(4) Stay away from unfamiliar or illegal person-to-person activities posted on the Internet.
20.3 Guardians and schools should pay more attention for minors who use our services. We recommend that parents provide proper instructions to their children, with which to prevent them from any online dangers. If parents (guardians) think it’s necessary for their underaged children (especially those who are under 10) to use services offered by Moon lit, they may register an account for their children, but the account must be registered in the name of one of the parents (guardians), who will decide whether the services we provide are suitable for the minors.
